InstaResolve, LLC (“InstaResolve”) takes your privacy and the privacy of your clients seriously and is sensitive to potential concerns about how we use potentially confidential information we collect from and about you and/or your case. We are committed to helping to ensure that your confidential information is safe and handled properly.

 

By using InstaResolve, you consent to our Privacy Policy and our Terms of Use.

This Privacy Policy informs you of InstaResolve’s policies regarding the collection, use, processing, and disclosure of any personal consumer information.

The scope of this Privacy Policy covers both your use of the InstaResolve website and any other ways in which you may interact with InstaResolve, such as when you speak to us on the phone. It also describes the choices available to you regarding our use of your personal information.

Information We May Collect

InstaResolve will process personal information collected from you fairly and lawfully and will not use such personal information for purposes that are incompatible with the purposes for which it was requested and received. Your personal information will be used to promote efficiency and accuracy in handling your matter, to foster communication between you and others who will be assisting with your matter, to provide you with information about our services, and to help us improve our Website and your online experience.

 

Identifiers

We may collect your name, postal address, email address, and telephone number. You also have the option of signing into portions of our service using certain social media platforms (e.g., Google). If you choose to do so, information like your name, email address, language preference, and access token will be shared with us.

When you contact us, submit your case, submit an inquiry, complete an Intake Form, request or participate in alternate dispute resolution services, you may provide information such as your name, email address, phone number, business name and nature, employment, marital status, case name and status, names and contact information for the parties’ respective attorneys, insurance information, including health insurance, identity of any insurance adjuster. It also includes additional information provided to InstaResolve directly by you, such as when you complete an Intake Form or upload a video. Other information you choose to submit including facts relating to your matter.

We may collect information about you from third parties, such as the Court or State Bar, or other sources that are lawfully entitled to share your data with us, including from publicly available and third-party databases or services that provide information about business people that we believe will help us optimize our services to you. We add this data to the other information we have on file for you, solely for the purposes described in this Policy.

We may collect payment information as part of our billing practices. We use third-party payment processors (e.g., Wix) to process payments. If you use a third-party payment processor, payment details are processed directly by the third-party payment processor.

How We Use Your Personal Information

We will use the personal information collected about you for the purposes for which it was collected, for compatible purposes, as permitted or required by law, as necessary to carry out our duties, and as otherwise provided in this Policy. For example, we may use your data in the following ways:providing you with the information and services you request, managing our relationship with you, responding to your inquiries or requests, analyzing use of our website, processing your payments for services, customizing your case file, facilitate collaboration between you and InstaResolve, complying with disclosure laws, sending you communications including email notifications during the pendency of your case and other documents, managing your user account, if any, ensuring that content from our website is presented most effectively to you and your device.

InstaResolve will never sell your personal information or data to third parties. We may send you emails or other announcements involving InstaResolve that may be of interest to our users.

When required, we will share the personal data we collect from you under the following circumstances:

We will share personal data if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce the Terms of Service for our website, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with our services, or (iv) such action is appropriate to protect the rights, property or safety of InstaResolve, LLC, and, if applicable, its employees, Neutrals, users of our services or others.

We may disclose your personal data in response to lawful requests by public authorities, including to meet national security or enforcement requirements.

Applicable Law

This Policy is governed by the substantive laws of California, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within California. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.

California Consumer Privacy Act (“CCPA”) for California Consumers /Individuals. CCPA, codified at California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information under certain circumstances. Requests may be made one time per calendar year. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. You may submit your request using the contact information at the end of this Policy. Please note that we do not disclose your personal information to third parties for the third parties’ direct marketing purposes.

If you are a California resident under the age of 18, and a registered user of any website where this Policy is posted, California law permits you to request and obtain removal of content or information you have publicly posted. You may submit your request using the contact information at the end of this Policy. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

The CCPA supplements and amends the information contained in our Policy as set forth above and applies solely to individuals, visitors, users, and others who are residents of the State of California and describes our policies and practices regarding the collection, use, and disclosure of personal information we collect about you, including personal information you submit or we obtain when you access our website.

Third Party Sites and Services

For your convenience and for advertising purposes, we may link to third-party sites and services, or otherwise display third-party content through our websites to provide increased value to our visitors. We have no control over these linked sites, each of which has separate privacy and data collection policies and practices independent from us. As such we have no responsibility or liability for these independent policies or actions and are not responsible for the privacy practices or the content of any such websites. Your Rights

Under California law and if you are an individual consumer, you have a right to notice, upon collection, of the categories of personal information collected and the purposes for which the information will be used. You also have the right to access a copy of the categories and specific pieces of personal information about you that we collect, use, disclose, and/or sell, and the right to ask us to delete or anonymize your personal information, subject to some exceptions. You also have the right to opt-out of the sale of your personal information. Finally, you have the right to be free from discrimination for exercising your rights.

Before we will be able to process your request for access or deletion of personal information, we will need to properly verify your identity for security purposes. If we possess appropriate information about you (e.g., name, email, address), we will attempt to verify your identity using that information. If it is not reasonably possible to identify you, we may not be able to respond to your request.

To use an authorized agent to make a request on your behalf, we may need the authorized agent to provide proof that you gave the authorized agent signed permission to submit the request on your behalf. We may also require you to verify your identity directly with us.

Certain exceptions apply to the rights discussed above.

Children’s Privacy

InstaResolve is not intended for users under the age of 16 and InstaResolve does not knowingly collect personal information from individuals under the age of 16. If you are aware of, or suspect that, someone under the age of 16 is using InstaResolve without permission, please notify us immediately by contacting us as detailed below. If you have questions or concerns about the Internet and privacy for your child, we encourage you to check out the FTC Guidelines for protecting your child’s privacy online.

Effective Date and Changes to Policy

This Privacy Policy is effective as of the date at the top of this policy. InstaResolve has the discretion to update this Privacy Policy at any time. When we do, we will revise the effective date at the top of this page. We encourage users to frequently check this page for any changes and to stay informed about how we are helping to protect the personal information we collect, especially before you provide information, and particularly personal information, directly to InstaResolve.

Mediation

​

You also agree that, in the event any dispute or claim arising out of or relating to your use of InstaResolve or this Privacy Policy that does not relate to your personal data, or that is not covered by the previous paragraph, you and InstaResolve will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via email or personal delivery) that a dispute exists, all parties shall join in mediation services in Los Angeles, California with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that to the maximum extent permitted by applicable law, you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.
